SOLTURA DE “BALÕES SEM FOGO”: A INCONSTITUCIONALIDADE DE LEIS MUNICIPAIS QUE AUTORIZAM ESSA PRÁTICA E A TIPICIDADE CRIMINAL DA CONDUTA

Resumo

A prática da soltura de balões sem fogo tem sido autorizada por algumas leis municipais, representando significativa dificuldade para a navegação aérea. Este artigo irá demonstrar que normas municipais que permitam tal conduta incidem em plena inconstitucionalidade formal, à medida que ingressam em competência legislativa privativa da União. Também será analisada a perfeita subsunção da conduta de soltar balões sem fogo ao crime de atentado contra a segurança do transporte aéreo, na modalidade de dificultar a navegação aérea. Por fim, o artigo apontará as medidas judiciais necessárias para a recuperação da segurança da navegação aérea, em razão da existência de leis municipais que autorizam a prática baloeira sem fogo.

Abstract:
The practice of releasing balloons without fire has been authorized by some municipal laws, representing significant dificulty for air navigation. This article will demonstrate that local laws permitting such conduct suffer in formal unconstitutionality, because legislate in matters of deprivation of Union. Also will be analyzed the perfect subsumption of conduct of launch balloons without fire to the crime of attack on the safety of air transport, in the form of hinder of navigation. Finally, the article will indicate the judicial action to recover the safety of air navigation,by reason of the existence of municipal laws allowing the practice of launch balloons without fire.
