RÁDIO COMUNITÁRIA CLANDESTINA: O DIREITO À INFORMAÇÃO E A SEGURANÇA DAS TELECOMUNICAÇÕES AERONÁUTICAS

Resumo

O delito de exploração clandestina de estações de rádio comunitárias tem sido analisado, pelo Supremo Tribunal Federal, como uma conduta materialmente insignificante, tanto pela baixa cobertura deste tipo de rádio, como em casos concretos cuja localização da estação emissora esteja distante de grandes centros e aeroportos. No entanto, a aviação possui caracteres tão especiais que tais elementos não são aptos a retirar o perigo que a indisciplina do uso do espectro eletromagnético produz para a segurança do transporte aéreo, em especial, para as telecomunicações aeronáuticas e para a navegação aérea, tornando incompatível a qualificação de bagatela para tais condutas, entendimento este também partilhado pelo Superior Tribunal de Justiça.

Abstract:
The delict of clandestine exploration of communitarian stations of radio has been analyzed, for the Supreme Federal Court, as a materially insignificant behavior, as much for low the covering of this type of radio, as in concrete cases whose localization of the emitting station is distant of great centers and airports. However, aviation possess characters so special that such elements are not apt to remove the danger that the indiscipline it use it electromagnetic specter produces for the security of the air transportation, in special for the aeronautical telecommunications and the air travel, being become incompatible the qualification of trinket for such behaviors, agreement this also agreed to by the Superior Court of
Justice.
